A wave of elected officials across the United States is reversing position on data center development, responding to intense public opposition over energy consumption, water use, and rising utility costs tied to the AI infrastructure boom.

At least 11 governors, senators, and candidates running for office this November have either imposed construction moratoriums, suspended tax incentives, or established new regulatory frameworks for hyperscale data centers — facilities that can consume 50 megawatts or more of electricity. The policy reversals

New York Governor Kathy Hochul in July became the first to impose a one-year moratorium on hyperscale AI data centers, despite telling reporters in May that such decisions should remain with local municipalities. Pennsylvania Governor Josh Shapiro, who previously touted Amazon's $20 billion data center investment as "the largest private sector investment in the history of Pennsylvania," unveiled strict new guardrails in August requiring developers to secure local approval before receiving state permits. When asked about his reversal, Shapiro told CBS News: "I listened. I think it's important for elected leaders to actually get the vibes of a community."

Texas Governor Greg Abbott announced an effective pause on new grid connections in August, ordering a comprehensive audit of data center power demands. Abbott, who months earlier celebrated Google's $40 billion Texas investment as proof the state is "the epicenter of AI development," blamed developers for failing to coordinate with state and local governments. "They basically dug their own grave," he said on ABC's "This Week."

Tax breaks and transparency requirements

Several Democratic governors moved to eliminate or pause financial incentives. Arizona Governor Katie Hobbs pushed through a three-year suspension of data center sales tax breaks, acknowledging she had voted to create the incentive as a state lawmaker over a decade ago. Illinois Governor JB Pritzker suspended new tax incentives in June, with a spokesperson saying "responsible governance means reassessing incentives when circumstances change."

Maryland Governor Wes Moore established guidelines requiring data centers to hire local workers and cover their own power costs, positioning Virginia's Data Center Alley as a cautionary tale. Utah Governor Spencer Cox issued an executive order calling for "a higher bar" after initially defending a controversial 40,000-acre hyperscale campus proposal.

Federal and state races

The issue has entered campaign politics. Florida Republican gubernatorial nominee Byron Donalds is running ads promising to "protect Florida families and communities from data centers," despite previously dismissing calls for construction bans. Ohio Republican gubernatorial nominee Vivek Ramaswamy pledged to pause new project approvals until lawmakers pass requirements including free electricity for residents in data center communities. Michigan Senate candidate Mike Rogers called for a one-year state moratorium after previously suggesting communities would welcome the property tax revenue.
