School Districts Struggle to Vet AI Tools Amid $15B Market Surge

As education AI spending accelerates, districts face an overwhelming vendor landscape with limited state guidance on safety, efficacy, and procurement.

School districts across the United States are confronting a rapidly expanding market of artificial intelligence tools—from platforms that flag struggling students to systems that monitor digital activity—but most are making high-stakes purchasing decisions without comprehensive state or federal guidance.

The AI education market generated approximately $2.5 billion in revenue last year and is projected to exceed $15 billion by 2033, according to Grand View Research. Yet educators report feeling overwhelmed by vendor options, with limited frameworks for evaluating which tools justify investments that can reach millions of dollars.

"There's always an asymmetry between what the providers know and what the districts know," Mark Schneider, a senior fellow at the American Enterprise Institute, told Stateline, which first reported these details. "And the question is, can we set up mechanisms for helping the districts understand what's going on and choosing better."

Why it matters

School districts are being asked to evaluate complex AI systems for safety, data privacy, and educational efficacy—responsibilities that typically require specialized technical and legal expertise—while managing shrinking budgets and the expiration of pandemic-era federal funding. Without standardized vetting protocols, districts risk deploying tools that fail to improve outcomes, compromise student data, or introduce algorithmic bias into classrooms.

Testing approaches vary widely

Sumner County Schools in Tennessee piloted Coursemojo, an AI-powered literacy tool, starting with a five-day trial in one sixth-grade classroom before expanding to half its sixth-grade classes. Superintendent Scott Langford said the district sought tools that help teachers "see student understanding more quickly" rather than replace instructional roles.

The Allentown School District in Pennsylvania employs a two-phase review requiring vendors to guarantee that student data remains district property and will not be used to train AI models. Superintendent Carol Birks noted that while her district has built internal capacity for these reviews, state-level guidance would significantly help smaller systems.

"A significant challenge is that the onus of making these decisions is placed entirely back on the individual school district," Birks said.

Emerging guardrails and cautionary cases

Some states have begun filling the guidance gap. Pennsylvania's Department of Education instructs schools to limit data collection, keep humans involved in grading and discipline decisions, and assess whether tools actually improve student performance. New York City updated its privacy review process to require AI capability disclosures and prohibit using student data for model training. Chicago Public Schools began blocking unapproved third-party AI products from its network in December.

Meanwhile, legal challenges highlight procurement risks. Students and parents in Arizona and Kansas filed federal lawsuits challenging the Gaggle monitoring platform, alleging constitutional violations. In Los Angeles, the superintendent resigned after the district paid $3 million for an AI chatbot from AllHere, whose founder was later charged with fraud after the company filed for bankruptcy.

The accumulation problem

Districts face an additional challenge: digital tool proliferation. An Instructure report found that districts had access to an average of 3,001 digital tools, while students and educators actively used only four. Tracy Weeks, senior director of education policy at Instructure, described the situation as "digital hoarding" that districts are now being forced to rationalize.

Janice Mak of Arizona State University's Learning Engineering Institute emphasized that districts should evaluate whether tools are accessible, explainable, grounded in learning science, and solving genuine educational needs—not just responding to vendor hype.

"State level policy or guidance only goes so far, and there's also a research gap and there's also a policy gap," Mak told Stateline.
