EPA Proposes Letting States Control Air Permit Public Notices

The Environmental Protection Agency is weighing a significant shift in how communities learn about new pollution sources in their neighborhoods. A proposed rule change would transfer authority over public participation requirements for certain air permits from federal to state control.

The EPA held a public hearing Wednesday on the proposal, which focuses on "minor source" permits under the Clean Air Act. These permits cover facilities that emit pollution below major thresholds — a category that includes dry cleaners, auto body shops, and increasingly, the diesel and gas generators that power data centers.

According to details first reported by WIRED, companies like xAI and Meta have used minor source permitting to build behind-the-meter gas plants for their facilities. The proposed rule would let individual states determine "whether, when, and for how long to provide opportunities for public participation for proposed new minor sources and modifications," an EPA spokesperson said.

Why it matters

The timing coincides with mounting community resistance to data center construction nationwide. As AI infrastructure spending surpasses public transportation investment — data center construction outpaced transit spending for the first time in June — local permitting processes have become a key friction point. Weakening federal public notice requirements could remove one of the few tools communities have to engage with or challenge projects before construction begins.

State-by-state disparities

The current patchwork of state enforcement creates wide variation in public access. Georgia maintains robust notification and participation processes for minor sources, according to Keri Powell, an attorney at the Southern Environmental Law Center. Her organization recently used public permit information to alert state utilities about construction issues at a data center.

Texas demonstrates the opposite scenario. The state's data center boom has driven extensive private gas plant construction through minor permits, often leaving nearby residents unaware of the fossil fuel infrastructure being installed until after the fact.

Kentucky's senior attorney at the Kentucky Resources Council, Byron Gary, noted that state agencies have made informal commitments to maintain current participation rules even if federal requirements change. But he acknowledged uncertainty about future administrations.

Data center development push

The Trump administration has explicitly prioritized artificial intelligence infrastructure, with the EPA working to make the United States "the AI capital of the world," according to the agency spokesperson. The proposed rule doesn't alter emissions standards themselves, but community advocates argue it represents part of a broader effort to accelerate data center construction.

"As someone actively working in communities with data centers, I know this to be fundamentally true: People want to have a say," Vanessa Lynch, a Pennsylvania organizer with Moms Clean Air Force, testified at the EPA hearing.

Powell characterized the rule revision as "part of a package of rules that the Trump administration is pushing through to make it easier for AI data centers to be constructed."

Georgia's Environmental Protection Division said it is "determining whether proposed federal rule changes would affect the public participation requirements per the state regulations."
