New Regulations Target Data Center Expansion

Virginia Governor Abigail Spanberger has signed an executive order establishing what she describes as the nation's most comprehensive data center accountability framework, addressing mounting concerns about the industry's rapid expansion across the commonwealth.

The initiative, announced Friday, implements immediate restrictions on non-disclosure agreements for data center projects involving state agencies and creates new oversight mechanisms for environmental impacts and community engagement. Core Components of the Framework

The executive order prohibits all executive branch entities—including agencies, departments, boards, and commissions—from entering into or requiring NDAs related to data center projects. Additional provisions direct state agencies to expedite development of noise regulations specific to data centers and conduct comprehensive reviews of diesel backup generators and other emergency power systems. The framework also establishes a planning toolkit to help local governments navigate data center proposals and evaluate their community impact.

The order directs efforts to channel data center investments toward local energy infrastructure and develop best practices for creating jobs and workforce development opportunities tied to new facilities.

AI Task Force Established

Spanberger's executive order also creates an AI Task Force charged with examining risks associated with artificial intelligence development, including workforce displacement, data privacy concerns, and cybersecurity threats. The task force represents Virginia's effort to address AI governance as the technology becomes increasingly integrated with data center operations.
